By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Services.
Any engagement for M&A advisory, valuation reports, fairness opinions or similar services is governed exclusively by a separate written engagement or mandate agreement. These Terms apply only to your use of the website and our free or trial tools and content.
The Services are aimed at business users (companies, founders, investors and other professionals) and are not intended for consumers.
Through the Services, we may provide:

- ›free online valuation tools and calculators
- ›sector and market research, analyses and educational content
- ›newsletters and other marketing communications

We may add, modify or discontinue features or content at any time.
Our valuation calculators and other tools are provided for general, indicative information only. In particular:
- ›results are based on the data you provide and on general market assumptions and benchmarks

You agree to:

- ›not misuse the Services, including by attempting to gain unauthorised access

However, you acknowledge that communication over the internet can never be completely secure, and the website is not designed for regulated or highly sensitive data. - ›Our total aggregate liability shall be limited to the amount of fees (if any) you have paid to ExitAce AG for chargeable services in the twelve (12) months preceding the event
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under mandatory law (including liability for intent or gross negligence, or for personal injury).

We may update these Terms from time to time. We will publish the updated Terms on this page with an updated "Last updated" date. Material changes may be highlighted on the website. If you continue to use the Services after the updated Terms become effective, you are deemed to have accepted them.
These Terms and any disputes arising out of or in connection with them are governed by the substantive laws of Switzerland (excluding its conflict-of-laws rules).
The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms or the Services is Zug, Switzerland, subject to mandatory jurisdictions that cannot be changed by agreement.
